2. What these terms apply to
To every order you place through donerlandbreda.nl. By ordering, you agree to them.
3. How an order comes about
Your order is final as soon as you have completed the payment and receive a confirmation from us by email. That confirmation is the proof of the contract. If no confirmation arrives, please get in touch – then something has gone wrong.
We may refuse an order, for example if a dish has run out, if the address lies outside our delivery area, or if we have already closed. You will then get your money back.
4. Prices
All prices on the site are in euros and include 9% VAT. A delivery charge is added per postcode area; you see it at checkout before you pay. We may change prices, but never after you have ordered.
5. Delivery and collection
Our delivery area and the corresponding rates are on the delivery area page. A minimum order applies per area. For collection there is no minimum and you pay no delivery charge.
The delivery time you choose at checkout is an indication, not a guarantee. In busy periods, bad weather or roadworks it may run late. We do our best to reach you if that happens.
Please make sure you are reachable at the address you gave. If we cannot reach you and no one answers, we take the order back with us and your right to a refund lapses – the food is no longer usable by then.
6. Payment
You pay online through Mollie: iDEAL, Apple Pay, credit card or bank transfer. Cash on delivery is also possible, if that option is available at checkout.
7. Cancellation and the right of withdrawal
There is no cooling-off period on meals. That is not a rule of our own: article 6:230p of the Dutch Civil Code excludes the right of withdrawal for products that perish quickly or have a limited shelf life. Freshly prepared food falls under that.
If you call before we have started preparing, we cancel free of charge and you get your money back. Once the food has been made, that is no longer possible.
8. Complaints
If something is not right, let us know as soon as possible – preferably the same day, because afterwards it is no longer possible to establish what went wrong. Call 076 514 4011 or use the complaints form. We respond within fourteen days at the latest.
If we cannot reach an agreement, you may turn to the European ODR platform or to the courts.
9. Allergens
We work in one kitchen with shared equipment. Traces of allergens can therefore not be ruled out. On the allergens page you can read what we can and cannot guarantee. If you have an allergy, always tell us before you order.
10. Liability
We are liable for damage that is the direct result of a failure on our part, up to no more than the amount of your order. We are not liable for consequential loss or for delay caused by circumstances beyond our control. This limitation does not apply in the event of intent or gross negligence, nor where the law mandatorily provides otherwise – your statutory rights as a consumer remain fully in force.
11. Age
You must be sixteen or older to place an order independently. If you are younger, order with the permission of your parent or guardian.
12. Privacy
How we handle your data is set out in our privacy statement.
13. Applicable law
These terms are governed by Dutch law.
